Dear ChiroCongess Members:

We are writing to provide an update on activities that the ChiroCongress Board has been actively engaged in over the last few months related to Medicare initiatives.

Background Information:

In the Fall of 2018, the ACA asked ChiroCongress to share a letter with our state associations asking for support of HR 7157 – Chiropractic Patients’ Freedom of Choice Act of 2018. ChiroCongress, at that time, signed on in support of this initiative. This legislation never proceeded beyond that Congressional session.

Since that time, the ChiroCongress Board has been working diligently to bridge communications between the national associations and other stakeholders working on current Medicare legislative and administrative initiatives.

For the last several months, ChiroCongress has had meetings and discussions with the ICA, ACA and others about the need to work strategically on behalf of the entire profession. These discussions are an integral part of our efforts to work toward improved patient access and reimbursement parity for chiropractors in all Medicare programs.

Through these discussions, ChiroCongress has provided a forum for organizations to openly discuss the goals and objectives of their legislative and administrative efforts to end discriminatory policies and programs in Medicare. We have worked diligently to be sure all voices are heard.

Current Legislative Activities:

On May 21, 2019, HR 2883 Chiropractors Equity Act of 2019, championed by the ICA, was introduced by Rep. Jackie Walorski (R-IN-2)) and is publicly available on Congress.gov. ChiroCongress will continue to work with all stakeholders on vetting this bill language and consider any suggested strategies for passage. At this time, ChiroCongress has not been contacted by ICA in regard to our position on the bill, nor to ask member state associations to sign on in support.

On July 9, 2019, HR 3654 The Chiropractic Medicare Coverage Modernization Act of 2019, was introduced in the House by Rep. Brian Higgins (D-NY-26) and championed by the ACA. The ACA has once again reached out to ask ChiroCongress and member state associations to sign onto their new letter in support of HR 3654.

We have heard from several states that they are considering whether or not to sign onto the ACA letter of support for HR 3654. As your informative body, and in an effort to aid in transparency, ChiroCongress conducted a side-by-side review of HR 7157, introduced in November of 2018, with HR 3654, introduced on July 9, 2019. This was done to better understand any language changes before considering signing onto the ACA’s support letter. These findings are available online for those who wish to conduct their own vetting process which we strongly recommend.

The ChiroCongress board will continue to monitor this legislation, and keep you updated on any recommended actions or decisions made in relation to the ACA’s letter signing initiative.

ChiroCongress considers and tracks a wide range of legislative, regulatory, and legal issues, looking at policy matters in terms of their potential impact on chiropractic and our state association members. We support our association community in the legislative process by promoting legislation that has a positive impact on the profession.
